Lister Told Police He Found Missing Middle School Items 'In The Trash'

Latest arrest is not the first time Gino Lister has appeared before a judge.

 

After announcing their presence five times, Wellesley Police broke through a lock on Gino Lister’s apartment door to find the man they would charge with stealing computers and jewelry from the middle school standing in his living room with his newborn baby in a baby seat on the floor next to him, according to documents filed in Dedham District Court.

Police then ordered the Wellesley Middle School custodian to get down on the floor, and when he refused, Detective Christopher Connelly wrestled him onto a couch and then to the floor, patted him down, handcuffed him, moved him to a chair in the kitchen and read him his rights, according to the report.

That day was not the first time the 36-year-old Lister had been read his rights. In 1998 Lister admitted sufficient facts in a case in which he was charged with assault and battery after breaking a man’s jaw during a fight, according to Framingham District Court records. He was put on probation, ordered to perform 40 hours of community service and to pay $5,992 to the victim to cover medical costs, the records show.

And in 2000, Lister was again before a judge in Framingham District Court where he again admitted to sufficient facts, this time to breaking and entering in the night and unarmed robbery after he and two other men were charged with stealing a car, according to court records.

That case was continued without finding and dismissed after a year, according to the court records.

Last week Lister, who had been hired in June by the Wellesley Public Schools as a middle school custodian, was charged with larceny over $250 and receiving stolen property after an investigation that traced computers stolen from the school back to Lister.

The trail to Lister led police to apartments in Framingham and Marlboro where two brothers described purchasing a Macbook from a man matching Lister’s description, complete with details about his tattoos, according to the court records.

When the five Wellesley police officers and detectives entered Lister’s Holliston apartment after interviewing the brothers, it didn’t take them long to recover some of the more than $20,000 worth of electronic equipment and silver jewelry allegedly stolen from the middle school.

Wellesley Police Detective Peter McLaughlin saw a Sony iPod docking station and a Flip video camera “co-mingled with other innocent items” on Lister’s kitchen counter, according the the court papers. The Flip video camera was engraved with an internal control number used by the Wellesley Public Schools, and the serial numbers on the items matched those allegedly stolen, according the the court papers.

Officer Christopher Cunningham then found a silver ring and a bag of silver jewelry in the top drawer of Lister’s bedroom bureau which was “consistent” with the students’ art projects missing from the middle school, according to the court papers.

Lister denied having any involvement in the thefts and gave conflicting answers to questions about how he came into possession of the items, saying he found the electronics in the trash as the middle school and that the jewelry was his wife’s, the court papers show.

His wife, who arrived home in the midst of the arrest and search, told police her husband said he bought the flip video camera and docking station at a yard sale, according to the court documents, which also said she denied owning the silver jewelry.

The court documents also state that Lister’s wife told police her husband is currently in an outpatient program for substance abuse and that he was taking a medication to help him with an addiction to opiates. Opiates include the prescription painkilling drugs vicodin, oxycodone and percocet.

Why was this person ever hired to work in the Wellesley Public School system? I am a director of a school in Wellesley and any CORI checks must be CLEAR of anything that would cause an issue. Are you kidding me...this presents another case of soneone not doing his/her job when hiring a new employee. This guy had a chance to make a clean and respectable living and again, it was tossed to the wind.

It is shocking that this man had a record of violence and was hired to be around children. VERY shocking. Bella Wong has failed us. Remember how her salary was bumped up before she stepped into the job? The old supervisor had been there for years yet her salary was compared to his. Seems like things have been going downhill.

I agree with Virginia.and MJ. Why was this person hired to work with our children? I find this situation quite frightening. Was a CORI completed? If so, who viewed the results and made the decision to hire him? If one was not conducted , this would be totally unacceptable. Bella Wong has failed us and our children. An investigation into this issue must be conducted immediately. Have CORI checks been performed on all school employees? Are the employees of the new lunch service checked? Are CORI checks performed on all employees on an annual basis (they should be). I find this matter quite disturbing and hope other Wellesley residents feel the same.

Thank you, Ellen, for providing us with the real story.

As shocking as the background of the custodian is - and as upsetting as it is to think about WHO ELSE might still be employeed by the school system with similar backgrounds, I cannot understand why the school committee and the town allows the superintendent to remain employed. Where is the OUTRAGE! Can we list the RECENT WONG OUTRAGES: 1. a violent felon / subtance abuser working at the middle school, 2. no response to how the system is addressing its controls over electronics, 3. no response vis a vis business office personnel and the school lunch fiasco, 4. no responsibility taken or assigned on the lack of audits of the business office. I am sure you can add more. How many strikes until Bella and team are out???

Well you all should look at the people who are hiring your staff. If he had a record then he shouldn't have been hired. They also should look into drug testing and if they would of done this they might have saved the school some money. I agree if he did this then its his bad but maybe he should have never been given the oppurtunity!!!!
